BloomSignal Terms of Service

Welcome to BloomSignal. These Terms of Service ("Terms") are a legal agreement between you and Northern Lights Software LLC ("BloomSignal," "we," "us," or "our"), the operator of the website at https://bloomsignal.app and the related email alert service (together, the "Service").
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What BloomSignal Is
BloomSignal is a "set and forget" gardening notification tool. You sign in, provide a U.S. ZIP code, follow one or more weather-based "signals," and we email you when forecast conditions for that signal appear to be met — for example, heavy rain, an unexpected frost, a heatwave, or a soil-temperature milestone.
The Service is for general informational purposes only. It is a convenience tool to help you keep an eye on the weather as it relates to gardening. It is not professional agricultural, horticultural, or financial advice, and you should use your own judgment before taking any action in your garden.
2. Forecasts and Estimates Are Not Guarantees
You understand and agree that:
- Weather and forecast data come from third-party providers and can be inaccurate, delayed, incomplete, or unavailable.
- "Soil temperature" shown by the Service is an estimate derived from recent forecast air temperatures, not a direct soil measurement.
- Frost and freeze dates and similar timing signals are approximations based on regional models and your ZIP code, and may differ from actual conditions in your specific location.
- Alerts may be sent late, sent in error, or not sent at all (for example, due to forecast errors, polling gaps, email delivery failures, or downtime).
You should never rely solely on BloomSignal to protect plants, time plantings, or make any decision where a wrong outcome would cause you loss. Always confirm conditions yourself.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Service. By using BloomSignal you represent that you meet this requirement and that the information you provide is accurate.
BloomSignal is currently offered only to users located in the United States, and the Service is intended for U.S. residents. We do not market or knowingly offer the Service to users outside the United States.
4. Accounts
You sign in to BloomSignal using Google ("Sign in with Google"). You are responsible for activity that happens under your account and for keeping your Google account secure. You agree to provide accurate information, including a valid U.S. ZIP code, which is required to use core features.
5. Free and Pro Tiers; Payments
Free tier. The free tier lets you follow a limited number of signals (currently one).
Pro tier. The Pro tier unlocks all available signals for a recurring subscription fee billed in advance (plus any applicable taxes). The current price and billing period are shown to you at checkout before you subscribe.
Billing. Payments are processed by Stripe. We do not receive or store your full payment card details. By subscribing, you authorize us (through Stripe) to charge your payment method.
Automatic renewal. Pro subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel. We will charge your payment method on file for each renewal.
Cancellation. You may cancel at any time through the billing/customer portal accessible from your profile, or by contacting us. When you cancel, your subscription remains active until the end of the current paid period and does not renew after that.
Refunds. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial periods.
Price changes. We may change subscription pricing. If we do, the new price applies to renewals after we give you reasonable advance notice.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to access accounts, data, or systems that are not yours;
- Interfere with, overload, scrape, reverse engineer, or disrupt the Service or its infrastructure;
- Resell, sublicense, or commercially exploit the Service without our written permission;
- Use the Service to send spam or to harass others.
We may suspend or terminate accounts that violate these rules.
7. Your Content and Data
You retain ownership of the information you provide (such as your ZIP code and signal preferences). You grant us permission to use that information to operate and improve the Service. Our handling of personal data is described in our Privacy Policy.
8. Third-Party Services
The Service relies on third parties including Google (sign-in), Weather data providers, Stripe (payments), Email delivery providers, and our hosting and network providers. We are not responsible for the acts, omissions, availability, or content of those third parties, and their own terms and privacy policies may apply to you.
9. Service Availability and Changes
We provide the Service on an "as available" basis. We may add, change, suspend, or discontinue any part of the Service (including individual signals) at any time, with or without notice. We may also set or change usage limits.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that alerts will be accurate or delivered, or that the Service will meet your expectations. We are not responsible for any plant, crop, garden, or property loss or damage resulting from your reliance on forecasts, estimates, alerts, or the absence of an alert.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
11. Limitation of Liability
To the maximum extent permitted by law, BloomSignal and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, plants, crops, or goodwill, arising out of or relating to your use of (or inability to use) the Service.
To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) twenty U.S. dollars ($20).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you, and you may have additional rights.
12. Termination
You may stop using the Service and delete your account at any time (Profile → Remove Account; deletion requires re-authentication and typed confirmation). We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Rhode Island will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there.
